Terms and Conditions of Service
IMPORTANT: BY SUBMITTING THIS REQUEST FOR SERVICE,
YOU AGREE TO ALL OF THE TERMS AND CONDITIONS SET FORTH
HEREIN. HOWEVER, YOU MAY CANCEL THIS TRANSACTION WITHIN
THIRTY(30) DAYS FOR A FULL REFUND IF YOU NOTIFY US
AND RETURN THE EQUIPMENT TO PEOPLE'S PAGING IN ITS
ORIGINAL CONDITION. PLEASE KEEP A COPY OF THESE TERMS
AND CONDITIONS FOR YOUR RECORDS.
SERVICES: Paging Management IV, Inc d/b/a People's Paging provides
the Services through authority granted to it by the
Federal Communications Commission (the "FCC").
The Services are provided in compliance with and subject
to the rules and regulations of the FCC and applicable
state regulatory authorities. You may not use the
Services and/or Equipment for promotional purposes,
nor resell or transfer any of the Services or Equipment
or your rights hereunder without the prior written
approval of People's Paging. You may only use the
Services & Equipment for personal and lawful purposes
and for the purposes intended. People's Paging reserves
the right to immediately, without notice, discontinue
providing Services to any customer who uses the Services
for any purpose in violation of this provision (including
by example, and not by limitation, using the voice
mail feature as a group bulletin board).
EQUIPMENT: Your messaging device
(the "Equipment") is covered by the manufacturers'
warranty and repair policies only. People's Paging
warrants that the Equipment will be new or like new
when delivered to you and that it will transfer good
title to you, free & clear of all liens, at such
time as you have paid for the Equipment in full.
FEES: You may receive subsequent
invoices for ongoing Services, overcall charges, or
regulatory fees. You are responsible for paying all
charges associated with the Services and/or Equipment,
and all taxes or other charges levied on the Services
and/or the Equipment by any governmental entity. People's
Paging reserves the right to change your Service fees
at any time on thirty (30) days advance notice. You
agree that all prepaid fees are non-refundable in
the event you terminate your service after thirty(30)
days of the date of purchase. You agree to reimburse
People's Paging for any charges, costs or expenses
(including attorney fees and court costs) incurred
by People's Paging and its agents in collecting past
due fees or charges. You may be charged $20 for charge
backs on credit cards or checks returned due to insufficient
funds.
PAYMENT BY CREDIT CARD: People's
Paging requires credit card payment for purchases
conducted via this Internet website. Payment is required
in advance and is nonrefundable if you cancel your
service after thirty(30) days of the date of purchase.
You authorize People's Paging to seek payment from
your credit card issuer according to the payment plan
you have selected herein and you, as cardholder/customer,
acknowledge receipt of service and agree to perform
the obligations set forth in your agreement with the
issuer of the credit card. Such credit card billing
will remain in effect until you notify People's Paging
in writing to terminate such authorization.
DISCLAIMER OF WARRANTIES AND LIMITATION OF
LIABILITY: Telecommunications services may
be adversely affected by various conditions, including
but not limited to electrical interference, terrain,
weather, Acts of God or governmental authority (including
limitations on the availability of telephone numbers
or spectrum), equipment failure and user error. People's
Paging cannot guarantee the availability of the Services
at all times and under all circumstances, nor that
all messages will be received in a timely manner or
at all. People's Paging's prices for the Services
do not include insurance for these inherent risks.
PEOPLE'S PAGING SPECIFICALLY DISCLAIMS ALL REPRESENTATIONS
AND WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT
NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE OF THE SERVICES
AND EQUIPMENT. If the Services are interrupted and
remain interrupted for more than twenty-four consecutive
hours after you bring such interruption to People's
Paging's attention, and if such interruption is not
your fault, you may request a pro-rata credit towards
the amount of your monthly charge for Services and
such credit will be your sole remedy.
Except for the credits described in the immediately
preceding paragraph, NEITHER PEOPLE'S PAGING NOR ANY
3rd PARTY PROVIDER WILL BE LIABLE FOR ANY LOSS OR
DAMAGE WHATSOEVER RESULTING FROM YOUR USE OF THE SERVICES
AND EQUIPMENT, NOTWITHSTANDING THE FORM OF SUCH CLAIMS
(e.g. CONTRACT, NEGLIGENCE, OR OTHERWISE), ARISING
OUT OF ERRORS OR OMISSIONS, INTERRUPTIONS IN SERVICE,
MISSED PAGES, OR DELAYS IN THE TRANSMISSION, RECEIPT
OR STORAGE OF ANY MESSAGES. IN NO EVENT WILL YOU HAVE
ANY RIGHT TO RECOVER FROM PEOPLE'S PAGING OR ANY 3rd
PARTY PROVIDER ANY SPECIAL, PUNITIVE, INCIDENTAL OR
CONSEQUENTIAL DAMAGES, OR LOSS OF PROFIT OR REVENUES,
EVEN IF PEOPLE'S PAGING AND/OR SUCH THIRD PARTY PROVIDER
HAS BEEN SPECIFICALLY ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES. PEOPLE'S PAGING WILL NOT BE LIABLE FOR
ANY DAMAGES TO YOU OR ANY OTHER PERSON IN EXCESS OF
CHARGES PAID BY YOU FOR ONE MONTH OF SERVICES, REGARDLESS
OF THE FORM OF THE CLAIM.
MESSAGING NUMBERS: Each unit of
Equipment may have its own unique telephone number,
address or capcode. These numbers are assigned by
People's Paging and may be changed at the sole discretion
of People's Paging at any time, and you acknowledge
that you have no property right in any assigned number.
People's Paging may at any time replace or modify
your Equipment to accommodate any such change in telephone
numbers and you agree to promptly make your Equipment
available to People's Paging to accomplish such replacement
or modification.
MISCELLANEOUS: People's Paging reserves
the right to change these Terms and Conditions of
Service upon no less than thirty days prior written
notice, which may be made by any reasonable means.
If any of these Terms and Conditions are found to
be unenforceable by a court of competent jurisdiction,
the remainder of these Terms and Conditions will continue
in full force and effect. These Terms and Conditions
are governed by the laws of the State of New Jersey
and you agree that any action we might bring to enforce
the Terms and Conditions hereof may be brought in
the courts of New Jersey. Please check with your local
school concerning restrictions on teens using pagers
on school grounds.
